Terms of Service

These Terms of Service (“Terms”) govern your use of Piral’s website and application (the “Service”). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.

2. Accounts

  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate information and keep it updated.
  • You are responsible for all activities that occur under your account.

3. User content

A. What you can post

The Service allows you to create and share content such as reviews, ratings, notes, recommendations, lists/trips, and other materials (“User Content”).

B. Your ownership

You retain ownership of your User Content.

C. License to Piral

By submitting User Content, you grant Piral a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/display), distribute, and display your User Content solely for operating, improving, and providing the Service.

D. Responsibility for content

You are solely responsible for your User Content and the consequences of posting it. You represent that you have all rights needed to post it and that it does not violate any law or these Terms.

4. Prohibited conduct

You agree not to:

  • Violate any applicable law or regulation.
  • Post content that is illegal, defamatory, harassing, hateful, or infringing.
  • Post private or sensitive personal information of others without permission.
  • Attempt to access or interfere with systems or accounts you are not authorized to use.
  • Use the Service to spam, scrape, or abuse the platform.
  • Reverse engineer or attempt to extract source code except where allowed by law.

We may remove content or suspend accounts that violate these rules.

5. Friends, following, and visibility

Some features may allow you to follow others or share content with friends. You understand that:

  • Visibility depends on your settings and product features.
  • Content shared with friends may be re-shared if you allow it or if features permit.

6. Third-party services (including Google Maps/Places)

The Service may incorporate third-party services (e.g., Google Maps/Places). Your use of those services may be subject to their terms and policies. Piral is not responsible for third-party services.

7. Intellectual property

The Service, including software, design, text, and graphics (excluding User Content), is owned by Piral and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our permission.

8. Disclaimers

The Service is provided “as is” and “as available.”

We disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Recommendations and reviews are user-generated opinions and do not constitute professional advice.

9. Limitation of liability

To the maximum extent permitted by law, Piral will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.

In no event will Piral’s total liability exceed the amount you paid to Piral in the 12 months before the event giving rise to liability (or $100 if you paid nothing).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access to the Service at any time if we reasonably believe you violated these Terms or for security/operational reasons.
  • Upon termination, your right to use the Service stops. Certain provisions (e.g., IP, disclaimers, limitation of liability) will survive.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. We will update the “Last updated” date. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Guatemala, without regard to conflict-of-law principles.
